Body Language Analysis №4678: Joe Tacopina — Trump’s Newest Attorney —Eyes Wide Open

Trump’s newest attorney, Joe Tacopina, recently made the rounds on multiple national news networks. The video above, from MSNBC, includes an interview with Ari Melber.

Unlike most of my analyses, this one is written largely, but not entirely, from a differential diagnostic/teaching point-of-view (using the Socratic method).

The descriptions are included below the corresponding images.

Trigger Warning: This post also includes references to and images of cult leaders responsible for deaths and mass-suicides — as well as a mass-murderer.

One particular nonverbal display Mr. Tacopina displayed prominently (although, crucially, not continuously) during this interview was that both of his upper eyelids were frequently opened widely.

Taken in isolation, when both eyelids are widely opened, it should bring to mind the following possible thought-emotions/causes:

  • Surprise
  • Emotional Shock/Emotional Processing
  • Rage (Extreme Anger)
  • Fear
  • Drugs (Stimulants)
  • Psychosis (some, but not all examples Psychoses)
  • Melodrama/Deliberate Hyperbole (i.e., Over-acting, “The lady doth protest too much, methinks.”)
  • Side-effect of Forehead Botox (rare to unusual)
  • Medical Conditions (i.e., Thyroid Eye Disease, Parinaud’s syndrome, Rare lesions of the midbrain, etc.)

Surprise is a very short-lived thought-emotion (literally lasting only a second or two, no more) while Emotional Processing/Emotional Shock lasts a much longer time. Can you differentiate these two nonverbal displays? (Christine Lagarde, above, is displaying true surprise)

Is the behavior Mr. Tacopina displaying indicative of Surprise? Why/why not? Is the behavior of Mr. Tacopina displaying Emotional Processing/Emotional Shock? Why/why not?

Stimulants can also be a possible cause of frequent bilateral widely opened eyelids. What are some other behaviors/findings you would typically see in a person who is using stimulants?

What about Melodrama/Hyperbolic behavior? Never forget: Acting is a form of lying, but with consent of the audience — while lying is acting without the audience’s consent.

Thus, most everyone over-acts (melodrama) whilst lying — but only a relatively small percentage will under-act (i.e., displaying a blunted affect relative to any given situation), (Nikki Haley, above, captured in a Hyperbolic moment).

This behavioral axiom is particularly telling during confrontations, testimonies, on-camera scenarios, etc. — when the accused/suspected person is in the limelight.

Therefore, when a person is behaving melodramatically, there’s a high to very high-likelihood that they’re also lying.

Bilateral and frequently elevated upper eyelids (as well as sometimes retracted lower eyelids) are also possible indications of fear. Is Tacopina exhibiting other signs of possible fear? If so, what? (Putin, above, is exhibiting Fear and Emotional Shock)

Are there other signs of possible rage (extreme anger) present? Intriguingly, although mild and moderate levels of anger are associated with partial closure of one’s eyelids, when anger escalates to high levels, the eyelids will open widely.

Mike Shanahan (circa 2010) amidst a moment of moderate anger crescendoing to rage.

While some individuals with Psychosis have bilateral widely opened eyelids, not all people with psychosis exhibit this finding.

*Trigger Warning for next three posts (18 through 20)*

Examples of Psychotic individuals exhibiting bilateral widely-opened eyelids include Marshall Applewhite (Heaven’s Gate Cult and associated mass suicide), …

…Adam Lanza (Sandy Hook Elementary School Massacre), …

… and Charles Manson.

Occasionally (unusual, but not rare), people with moderate to heavy Botox treatments to their forehead will have the secondary side effect of eyelids that open much too wide than is their intention. Has Tacopina had relatively recent Botox injections in his forehead?

Callista Gingrich’s widely opened eyelids in this image are secondary to excessive Botox in her forehead.

Which of the above causes of bilateral eyelid retraction are also associated with diminished impulse control? (i.e., reaching across Ari Melber’s desk and repeatedly invading Melber’s personal space [intimate space] whilst trying to grab a document/notes out of his hand)? i.e., here during 7:06…,

… and here during 7:10 …

… and yet another invasion into Melber’s personal space (intimate space) during 9:44.

Thyroid eye disease can also result in bilateral eyelid retraction (as well as eyeballs [globes] which are pushed forward/”stick out” (aka proptosis or exophthalmos). The above image is a patient with both proptosis and extreme bilateral eyelid retraction.

Although medical testing would be required to rule this out, Tacopina does not have the appearance typical of Thyroid Eye Disease.

Also, we would expect eyelid retraction associated with Thyroid Eye Disease to be persistent, not intermittent — and behaviorally linked.

There are other (much rarer) causes of eyelid retraction, i.e., certain lesions of midbrain, such as Parinaud’s syndrome.

Parinaud’s syndrome can be ruled-out in Tacopina’s case, given his ability to also gaze upward. A key feature of Parinaud’s Syndrome is a paralysis of upwards gaze seen here in another interview given the same day.

Another notable behavior exhibited by Mr. Tacopina was his frequent use of ad hominem attacks against Michael Cohen.

At the very least, those who use disparaging verbal language are signaling that their arguments are weak (or non-existent). Ad hominem language is also a behavior of those who are perpetrating deception.

Moreover, Tacopina denies what was obviously and factually-proven lie committed by Donald Trump — saying it wasn’t a lie because it wasn’t done under oath (i.e., Perjury. Of course, the vast majority of lying is not done under-oath).

This Lying vs. Perjury distinction is Law School and Human Behavior 101 material — so fundamental and profound, that virtually every adult should have (along with Melber) caught it as they watched this interview.

Why is an experienced attorney, being interviewed on a major network, whose client is the former President of the United States, so blatantly misrepresenting basic law, psychology, and common sense?

Early in Ari Melber’s interview, Melber asks Tacopina, “Is Stormy Daniels a lawyer?” — Tacopina then asks the exact same question back to Melber, “Is Stormy Daniels a lawyer?”, Melber answers, “Yeah.”

Tacopina repeats a truncated version of the question again, “A lawyer?” — Melber re-asks, “Yeah. Is Stormy Daniels a Lawyer?”

Tacopina then says, “I thought you asking [sic] if she’s a liar. Is she a lawyer? I, I [stuttering and pausing] don’t think she’s a lawyer. I don’t think her lawyer was a lawyer [chuckling/feigned laughing]. But, ah, Stormy Daniels is not a lawyer.”

Note as Tacopina says, “liar” (during 0:28) “I thought you asking [sic] if she’s a liar”), Tacopina makes the following expression (please watch the video, as it’s impossible to capture the dynamics in a still image).

This is an example of a Rationalization Rapport Empathy Expression (R2E2). A Rationalization Rapport Empathy Expression is displayed by everyone from time-to-time.

However, those who display the R2E2 often or at crucial moments are trying to rationalize their behavior (and/or trying to gain your support in co-rationalizing). They’re also trying to build rapport with you and gain your empathy for their situation, opinion, or plan.

R2E2 can look a lot like disgust or contempt (Can you tell the difference?).

When you see an R2E2 displayed, always ask yourself, “Why is this person trying so hard to gain my rapport and empathy? Why do they want me as a co-rationalizer? Are they displaying this behavior too frequently?

Ryan Goodman (Chaired Professor NYU Law, Former Special Counsel Dept of Defense, Former Chaired Professor Harvard Law, etc.) tweeted yesterday, “Joe Tacopina has had an attorney-client relationship with Stormy Daniels.”

Here is the link to Ryan Goodman’s tweet https://twitter.com/rgoodlaw/status/1636737103370285062

…and here is Goodman’s screenshot of a transcript of crucial exchange between Tacopina and Don Lemon during an exchange on CNN in 2018:

The reason Tacopina asked, re-asked, and re-asked again the above-noted question, stuttered, chuckled/feigned laughter, and displayed an R2E2 expression is because all of the following (over-lapping reasons) are true:

A. The question caught him off guard

B. He was stalling for time

C. The question gave him significant anxiety

D. Tacopina had an attorney-client relationship with Stormy Daniels

E. Tacopina knows he cannot represent Trump in any case relating to Stormy Daniels

E. Tacopina knows that he’s not being forthright.

F. Moreover, Tacopina’s statement, “I thought you asking [sic] if she’s a liar (referring to Stormy Daniels) is a form of projection/Freudian Slip — for Tacopina committed a lie of omission by not telling Ari Melber, the audience, (and possibly Trump) that he, in fact by his own description, had an Attorney-client relationship with Ms. Daniels.

SUMMARY: Joe Tacopina’s eyelids were opened widely and frequently during this interview.

Whenever you see a person frequently displaying bilaterally, widely opened (upper) eyelids, it should bring to mind the following possible thought-emotions/causes:

• Surprise

• Emotional Shock/Emotional Processing

• Rage (Extreme Anger)

• Fear

• Drugs (Stimulants)

• Psychosis

• Melodrama/Deliberate Hyperbole (thus possible deception)

• Side-effect of Forehead Botox

• Medical Conditions

Joe Tacopina’s repeated ad hominem attacks demonstrate his belief that his client, Donald Trump, has a weak defense.

Joe Tacopina is claiming Trump did not lie because it’s not “material, under oath, in a proceeding”. Tacopina is ethically wrong — and factually and legally incorrect.

In this interview, Joe Tacopina exhibited significantly diminished impulse control. Why?

Joe Tacopina, by his own admission, had a previous attorney-client relationship with Stormy Daniels and thus cannot represent Donald Trump in any manner related to her.

Did Joe Tacopina ever reveal to Donald Trump that he had had an attorney-client relationship with Stormy Daniels? If so, did this reveal occur prior to or since Tacopina taking Trump on as his client?

Did Donald Trump knowingly retain, or has he continued to keep Joe Tacopina as his attorney, in an effort to gain knowledge, evidence, and privileged insight to what he otherwise would not have access?

Body Language Analysis No. 4316: Sarah Paulson, The Met Gala, and Madonna - Nonverbal and Emotional Intelligence (VIDEO, PHOTO)

Sarah Paulson was recently a guest on The Graham Norton Show promoting Ocean's Eight - a film in which she co-stars. In the video above, Ms. Paulson recounted The 2018 Met Gala - where she was upstaged by Madonna.

This image was captured at the moment when Ms. Paulson realized the reason no one was paying her any attention was because Madonna was standing nearby.

Sarah Paulson is an accomplished actor, however the emotion of surprise is virtually always portrayed erroneously while performing. This moment was true surprise. How can we differentiate sincere surprise from feigned/poorly acted surprise?

First, and most importantly, look at Paulson's mouth. It's opened very widely - as one would expect, but more specifically, it's in the shape of a vertically elongated oval. People who fake surprise (including actors) will open their mouth widely - however it's oriented wider horizontally.

But let's thin-slice this moment even further. Another reason we can be sure this moment is projecting sincere surprise is the lack of any visible teeth. In the first moment of surprise, teeth are rarely visible. When surprise is spurious - teeth are exposed.

You've probably noticed that Paulson's eyelids are opened widely - as they should be during true surprise. However, you've perhaps also picked up on the fact that Paulson's eyebrows are not elevated. While certainly one's eyebrows may be elevated during surprise - when the eyelids are opened very widely, but the eyebrows remain relatively neutral - this also indicates genuine surprise. This facial expression detail is difficult to fake - particularly on the fly. And it's also a nuance of which few actors are even aware - and rarely it is mastered.

Surprise is a very short-lived emotion - lasting only for a second or two. If it appears to last longer, it's either psychological shock, or much more commonly, it's bogus. The surprise is then rapidly followed up with another emotion (fear, anger, sadness, joy/happiness, etc.). Sarah Paulson's surprise was immediately supplanted by smiles and laughter.

Body Language Analysis No. 4295: Elizabeth Holmes, Theranos, and Red Flags - Nonverbal and Emotional Intelligence (VIDEO, PHOTOS)

Three years ago, Elizabeth Holmes was the newest Golden Child of Silicon Valley. Her company, which she started when she was just 19 after dropping out of Stanford University, had claimed to have revolutionized the practice of medicine by being able to perform testing on just a few drops of blood - from only a finger prick (only 1/100 to 1/1000 of that typically needed with conventional methods). Such a discovery would also dramatically decrease the costs of blood tests. Ms. Holmes also had quite a knack for convincing investors to bankroll her company - which they did to the tune of hundreds of millions of dollars.

But in October of 2015, based on the work of John Carreyrou of The Wall Street Journal, deep concerns as to the credibility of Theranos' technology were raised - and the facade failed.

What follows is a partial nonverbal analysis of Ms. Holmes from this April 2015 CBS interview.

The aberrant behavior of Elizabeth Holmes' eyelids is striking. Note how widely they're opened. The "whites of her eyes" (sclera) are visible 360º around the colored portions (irides or irises) of both eyes.

Moreover, her eyelids are open to this extreme - not just for a second or two - but nearly continuously throughout this interview. This is extremely unusual.

Additionally, in the image immediately above (2:25), Ms. Holmes is also displaying a component of Disgust (note her tightened and forward-vectored mid and lower face - along with her nostril flaring and tightened lips).

You may have also noticed that Elizabeth Holmes blinks much less frequently than normal. This should immediately jump out to you as unnatural. This red flag is a behavior correlated with nefarious motives - so much so, that it's even been used in animations for decades.

Now, you may say that maybe Elizabeth Holmes' forehead had been treated with Botox - and you'd be correct. But although her forehead activity is somewhat diminished due to Botox - the dynamic movement captured here (3:48) proves that it is still quite functional. Concave-up furrows are clearly visible on her forehead and her eyebrows are also momentarily elevated.

It's profoundly important to stress - that when a person's eyelids are opened wide during moments of verbal emphasis - there is almost always a simultaneous contraction and elevation of their forehead muscles too - as was imaged in this last example.

But the fact that such forehead contribution was rarely seen throughout this interview - that her eyelids were opened wide with a relaxed forehead - and this display was virtually continuous - is a tremendous red flag. It screams of deception. It also signals psychological pathology.

Intriguingly, although the frequency of Ms. Holmes' voice is quite deep - witnesses have documented that she's feigning. It's another affectation.

Jennifer Lawrence will be playing Elizabeth Holmes in a 2019 film version of this fall from grace. It's to be titled Bad Blood and will be directed by Adam McKay (The Big Short).

SUMMARY: In the abstinence of a few medical conditions (such as Thyroid eye disease), when the eyelids are opened so widely, with such high frequency and long duration - coupled with a relaxed forehead (e.g., as is demonstrated in the first three images and during almost this entire interview), there's a very high correlation with:

• Deception
• Antisocial Personality Disorder (commonly referred to as Sociopath Behavior)

Body Language Analysis No. 4279: Rudy Giuliani regarding President Trump's alleged Sexual Relationship with Stormy Daniels - Nonverbal and Emotional Intelligence (VIDEO, PHOTOS)

On Sunday 6 May 2018, Rudy Giuliani (one of President Trump's personal attorneys) appeared on This Week with George Stephanopoulos. The former NYC mayor displayed a plethora of nonverbal tells. What follows a partial nonverbal analysis focusing on one key passage of the interview.

GEORGE STEPHANOPOULOS (continuing at 0:56): So the President does deny any sexual relationship with Stormy Daniels?

RUDY GIULIANI: He has, ah, I have not - ah, I'm notta, as I said, I'm not involved in that, but the reality is he denies - she denied it, then at, when, when it was opportunistic right before the - election, she came forward - and then of course, the whole thing happened with - Michael Cohen, an-, and, a it's history now because it wasn't a campaign anything ah, that -

The image immediately above was captured during the 1:00 mark as Rudy Giuliani said, "... has, ah ..."

From 1:15 - 1:16, as Mr. Giuliani "... history now because it wasn't a campaign ...", although somewhat less in magnitude (vs. the first example), he repeated the same eyes wide opened display.

The significance of widely opened upper eyelids - when occurring:

• Out-of-context
• Frequently

... can't be over-emphasized.

This Out-of-Context, Eyes Wide Open display simply screams that the person is trying too hard to convince you. Why? Because they don't believe it. Because they're lying. It's a profound and classic signal of insincerity. Indeed, if you were a directing an actor who was playing a deceptive scene/role - this is one nonverbal signal you'd want them to adopt.

SUMMARY: Rudy Giuliani's nonverbal behavior in this interview indicates that he believes Donald Trump did have a sexual relationship with Stormy Daniels.

Body Language Analysis No. 4129: Charles Manson's Eyes - Nonverbal and Emotional Intelligence (PHOTOS)

Charles Manson died in prison on Sunday. The cult leader was serving a life sentence for the murder of nine people in 1969. He was eighty-three years old.

Manson's appearance has come to symbolize, in many peoples' minds, the face of a crazed killer. A psychopath. The detail which most people remember are Charles Manson's eyes. They are opened very widely. But more specifically, what is it exactly about this expression that gives people "the chills"?

In this (anti)iconic photo of Manson - note how widely his upper eyelids are opened - his right eye more so than his left. His eyebrows are also elevated - which is also greater on his right side.

An astute observer may notice that Manson's nostrils are flared (again, with a bias on his right).

Now, look at the rest of his face. Although this image is of lower resolution, we can see his forehead is fairly relaxed, with minimal dynamic furrows present.

Next, try covering the upper two-thirds of his face - and look only at his mouth - it's relaxed, neutral.
The three primary emotions which involve widely-opened eyelids are:

• Intense Anger (Rage)
• Fear
• Surprise

With mild-to-moderate levels of anger, the eyelids will partially close and the mouth opening will tighten. With high levels of anger, however, this eyelid dynamic will reverse direction and the eyes will open very widely. The same wider-open configuration of intense anger/rage will also be true of the lips (and often of the mouth too - although sometimes while the lips will pull back - baring clenched teeth).

The mouth of fear is highly characteristic - with the corners of the mouth vectored backward (laterally) and down.

A mouth of surprise displays a classic vertically-oriented oval opening - with no teeth visible.

What makes Manson's face so "freaky" is that while his eyes are opened so very widely - the rest of his face (except for his nostrils) are relaxed. It's difficult to make such an expression without practicing - yet Manson did it all the time. It doesn't make sense. It confuses us. It feels odd. Normally the mouth is also "participating" with such an extreme eye expression - but not here. Thus, taken on their own, his extremely widely-opened eyes are considerably alarming - but the dramatic incongruity with the rest of his face is what really horrifies us.

Body Language Analysis No. 4075: Equifax Chairman and CEO Richard F. Smith Steps Down After Massive Hack/Data Breach - Nonverbal and Emotional Intelligence (PHOTOS)

Earlier today, Richard F. Smith announced he will be "stepping down" as the Chairman and CEO of Equifax. This change comes after the company's massive data breach - historically, one of the largest hacks anywhere (143 million accounts). The fifty-seven year-old will not be taking a bonus. He will be staying on for three months as an "unpaid consultant" (a common MO in order to help replacements get "up to speed").

Equifax has come under significant criticism for multiple issues related to this failure of cybersecurity: their poor security (e.g., hiring a music major, Susan Mauldin, as Chief Security Officer), delaying informing the public of the breach for six weeks, the alleged selling of stock by several high-level executives prior to the disclosing the hack, and Equifax's attempt to make a profit from those seeking to protect their credit in the wake of the company's failures.

The above image of Richard F. Smith, and the close-up below, shows a classic fear response.

The most striking signal are his eyes. Specifically, his upper and lower eyelids are opened very widely - much wider than baseline. While it is common for people to deliberately open their eyes very widely for effect - such affectations are performed with the aid of the forehead muscles. But Smith's forehead is NOT contracted - his slight wrinkles are passive (normal for age) and not indicative of muscular contraction of the forehead muscles. This "Eyes Wide Open" display - together with a relaxed forehead, and his other facial displays, is an absolute classic fear expresssion.

Note also Mr. Smith's nostrils - they are mild-moderately flared. There's also accompanying mild tension in his "mustache area".

Chin-holding, when taken in isolation does not indicate fear - however, when it's displayed as part of a cluster with one's eyes widely opened, relaxed forehead, tension in the mustache area, and nostril flaring - such chin-holding is a "fear amplifier". Indeed, Smith's psyche very much wants to cover his mouth as part of his fear manifestation - but he's suppressing this action (barely).

Summary: Richard F. Smith, who announced his "retirement" from Equifax today, is displaying significant trepidation in this photo. If this image was taken after the hacking, his nonverbal behavior would strongly suggest he fears personal repercussions. In that case, it would imply there may be important facts with the events related to the Equifax Hack which are yet to be revealed.

In the absence of nonverbal skills, anything described as "Crisis Management" significantly amplifies one's liability.

Body Language Analysis No. 3937: Mr. Lavrov Goes To Washington - “Was he fired? You’re kidding!” - Sergey Lavrov, Rex Tillerson, and James Comey - Nonverbal and Emotional Intelligence (VIDEO, PHOTOS)

This past Wednesday, 10 May 2017 - only a day after Donald Trump fired FBI Director, James Comey - Russian Foreign Minister, Sergey Lavrov and Russian Ambassador, Sergey Kislyak visited with President Trump in the Oval Office. The video clip above was captured in the US State Department on that same day. Many people have noted and commented regarding Minister Lavrov's sarcastic quip - but almost no one saw what feelings he betrayed on his face just prior to his retort.

What follows is a partial nonverbal analysis.

After Secretary Tillerson's Statement, Journalist Andrea Mitchell asks Minister Lavrov (beginning at 0:27), "Does the Comey firing cast a shadow over the talks, gentleman?"

Minister Lavrov answers, "Was he fired? You're kidding? You're kidding?"

For a split-second, as Ms. Mitchell says, the word, "... talks ..." (0:30), the Russian Foreign Minister displays an excellent example of a what is known as a microexpression. This reaction is involuntary and subconsciously driven.

Note that his eyelids open very widely - albeit extremely briefly. His mid-face also contracts - primarily in his "mustache area" as well as with flaring of his nostrils. Lavrov's mouth only moves a trace amount.

Thus this particular Microexpression is that of Fear. Something Andrea Mitchell said triggered in Lavrov an evanescent emotion of fear.

Watch this several times with a full screen and in slow motion. You'll also see his eyes, briefly looking forward, focus on the middle-distance, and rapidly fixate back-and-forth several times. This is an epiphenomenon of rapid cognitive and emotional processing when faced with something unexpected. This nonverbal dynamic is profoundly valuable in the negotiation, sales, and legal professions - for it's a signal of panic. And this is a textbook classic response.

What happens next is also very telling - for in his recovery from fear, Minister Lavrov makes a very universal and very human mistake - he overcompensates.

During 0:35 Mr. Lavrov:
  • Closes his eyelids for a long duration. This action indicates a dismissive emotional tone, physiological blocking, and also acts as a contempt amplifier.
  • Tilts his head quickly to the side - projecting dismissiveness (e.g., You are dismissed, this is beneath me, etc.). This emotion shares a large overlap with Contempt.
  • Displays a very open and classic Contempt expression on his face (his right side)
       0:36
  • Turns and shakes his head quickly, side-to-side and then walks away

Summary:

Sergey Lavrov was rattled by something in Andrea Mitchell's question. It's as if, for a moment, his psyche feared he had been caught (perhaps he even misunderstood something she said). Then he recovered - but in his defensiveness, Lavrov over-steered with his response. This nonverbal-verbal-paralanguage cluster display is absolutely classic for this behavior.
